Procedural Posture Plaintiff craigslist filed this action on April 20, 2009, seeking declaratory and injunctive relief. The object of the suit is to protect craigslist from a state criminal prosecution that Defendant McMaster has publicly, vigorously and repeatedly threatened to bring against craigslist based on its operation of a website on which third parties have allegedly posted ads relating to prostitution in violation of craigslist’s terms of use. The Complaint alleges that any such prosecution of craigslist would violate 47 U.S.C. § 230, the First Amendment and the Commerce Clause of the U.S. Constitution. On April 22, 2009, this Court entered a Consent Order providing that “[u]ntil the Court rules on the merits of craigslist’s claims, Defendants and their attorneys and staffs shall refrain from initiating or pursuing any prosecution against craigslist . . . in relation to content posted by third parties.” Consent Order (Docket No. 8). On July 21, 2009, Defendants filed a motion to dismiss the Complaint for failure to state a claim under Fed. R. Civ. P. 12(b)(6). Transcendence enables personalized access to the deep web by enabling users to partially reconstruct web databases in order to perform new types of queries. From just a few examples, Transcendence helps users produce a large number of values for form input fields by using unsupervised information extraction and collaborative filtering of user suggestions. Structural and semantic analysis of returned pages finds individual results and identifies relevant fields.
